Terms of Service
Last updated: 14 April 2026
These Terms of Service ("Terms") govern your use of the website operated by Australian Catering Equipment Supplies ("we", "us", "our") and any purchases you make through our website or by direct arrangement with us.
By accessing our website, placing an order, requesting a quote, or using our services, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.
If you do not agree to these Terms, you must not use our website or purchase from us.
Our store is hosted on Shopify, which provides the e-commerce platform that allows us to offer products and services online.

3. Products, Services, and Availability
We sell catering equipment, hospitality supplies, kitchenware, replacement parts, and related products through our website and, in some cases, through direct enquiries, quotations, or other local arrangements.
Certain products or services may:
- be available exclusively online
- have limited quantities
- be supplied on a special-order, indent, non-stock, or supplier-confirmation basis
- require separate freight assessment due to size, fragility, weight, commercial delivery requirements, or destination
All products are subject to availability. We may withdraw, discontinue, substitute, limit, or update products, pricing, specifications, or availability at any time before dispatch.
We aim to describe products as accurately as possible. However, product images, finishes, packaging, colours, dimensions, and specifications may vary slightly from what appears on your screen or from supplier-updated materials.
Where products are intended for commercial use, manufacturer warranties may require installation by a suitably licensed tradesperson. Failure to do so may void the manufacturer's warranty. It is the buyer's responsibility to ensure equipment is installed and operated according to manufacturer guidelines.
4. Quotes, Pricing, and Freight
Unless stated otherwise, prices shown on our website are in Australian Dollars (AUD) and are subject to change before an order is accepted.
Website pricing, freight estimates, and checkout shipping charges may not always account for every circumstance, particularly for:
- bulky or oversized items
- fragile goods
- commercial deliveries
- remote or regional destinations
- multi-carton or palletised freight
- split shipments
- supplier-direct dispatch
- urgent or special delivery requirements
Where additional shipping or handling charges apply, we may contact you before dispatch to confirm the updated amount and your available options.
A quote, freight estimate, or product listing does not guarantee availability, dispatch timing, or final freight cost until we have confirmed the order.
We reserve the right to correct pricing, freight, description, or listing errors before dispatch. If a material error has occurred, we may cancel the order and refund any amount paid, or contact you to confirm whether you wish to proceed on the corrected terms.
5. Orders and Acceptance
When you place an order, you are making an offer to purchase. Your order is not finally accepted until we confirm it and, where applicable, dispatch the goods.
We may refuse, limit, or cancel an order where reasonably necessary, including where:
- the item is unavailable
- pricing or freight is incorrect
- we suspect fraud, misuse, or unauthorised activity
- supplier availability changes
- the order appears to be for resale or commercial redistribution without prior agreement
- shipping or delivery details are incomplete or unsuitable
- the order cannot be fulfilled on reasonable commercial terms
If we cancel an order before dispatch after payment has been received, we will refund the amount paid for the cancelled portion.
6. Account Information and Order Details
You must provide accurate, current, and complete information when placing an order, requesting a quote, or maintaining an account.
You are responsible for ensuring that:
- billing and shipping details are correct
- contact details are current
- delivery instructions are accurate
- any special access requirements, timing constraints, or commercial site conditions are disclosed before dispatch
We are not responsible for loss, delay, or extra cost caused by incorrect or incomplete details supplied by you.
7. Payment
Payment must be made using the payment methods we make available at checkout or otherwise approve.
By placing an order, you confirm that:
- the payment information provided is valid and authorised
- you are authorised to use the selected payment method
- you will pay all charges associated with your order, including any approved additional freight or handling charges
We may use Shopify Payments or third-party payment providers to process transactions. We do not generally store full payment card details ourselves.
8. Shipping, Delivery, Pickup, and Timing
Our Shipping Policy forms part of these Terms.
Order processing times are separate from delivery time estimates. Dispatch and delivery times are estimates only unless expressly agreed otherwise in writing.
We may offer shipping, local delivery, pickup, or other fulfilment arrangements depending on the product and order.
If pickup is agreed:
- you must collect within a reasonable time after being notified the order is ready
- if collection is delayed, storage, redelivery, cancellation, or other reasonable charges may apply
If shipping is agreed:
- risk in goods may pass in accordance with applicable law and the delivery arrangement
- courier delays, weather events, transport disruptions, customs delays, incorrect addressing, failed deliveries, or uncollected consignments may affect delivery timing
Nothing in these Terms excludes any rights you may have where goods are not supplied within the time required by Australian Consumer Law.
9. International Orders
We primarily operate in Australia. International shipping may be offered at our discretion on selected orders only.
Where we agree to ship internationally:
- shipping times are estimates only
- customs duties, taxes, import fees, brokerage fees, and local charges may apply
- those charges are the customer's responsibility unless we expressly state otherwise
- compliance with local import laws and product suitability in the destination country is the customer's responsibility, except to the extent required by law
We may decline international orders where the freight, compliance, customs, or product suitability issues make the order impractical or commercially unreasonable.
10. Returns, Exchanges, and Store Credit
Our Returns & Refunds Policy forms part of these Terms.
Change-of-mind returns, exchanges, and store credit are offered only in accordance with that policy and may be subject to approval, restocking fees, excluded-product categories, and return conditions.
Nothing in these Terms excludes any rights you may have under Australian Consumer Law in relation to faulty, damaged, incorrect, or not-as-described goods. Consumer guarantees continue to apply regardless of store policy wording.
11. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law, including consumer guarantees that cannot lawfully be excluded.
Where goods or services are supplied to a consumer, or to a qualifying small business where the law applies, mandatory statutory rights may apply despite any other provision of these Terms. The ACCC warns businesses not to use terms that mislead customers about their ACL rights, including on refunds, delivery, and standard terms.
12. Website Content and Information
Information on our website is provided for general information only. While we aim to keep the website accurate and up to date, mistakes, omissions, outdated supplier information, or typographical errors may occur.
We may correct errors or update content at any time, including product descriptions, specifications, pricing, freight information, lead times, and availability.

Our website may contain or interact with third-party tools, apps, payment gateways, shipping systems, chat tools, marketplaces, or external links.
These services are provided by third parties over which we may have limited control. We are not responsible for the content, policies, functionality, or availability of third-party websites or services.
Your use of third-party services may also be subject to the third party's own terms and privacy policies.
14. Reviews, Feedback, and Submissions
If you submit reviews, comments, suggestions, ideas, feedback, images, or other content to us, you grant us a non-exclusive, royalty-free, worldwide, transferable licence to use, reproduce, adapt, publish, display, and distribute that content for operating, promoting, or improving our business, unless otherwise agreed.
You must not submit content that is unlawful, misleading, defamatory, infringing, abusive, obscene, or otherwise inappropriate.
We may remove or refuse to publish content at our discretion.
15. Intellectual Property
All content on this website, including text, graphics, logos, branding, layouts, images, product data compilation, and website materials, is owned by us, our licensors, or relevant suppliers and is protected by applicable intellectual property laws.

16. Privacy
Your submission of personal information through our website is governed by our Privacy Policy.
We may also use Shopify and other service providers to operate the store, process payments, manage shipping, customer communication, marketing, analytics, and related business functions.
17. Limitation of Liability
To the maximum extent permitted by law:
- we exclude warranties, representations, and liability that can lawfully be excluded
- we are not liable for indirect, incidental, special, or consequential loss, including loss of profit, loss of opportunity, or loss of business, except where liability cannot be excluded by law
Where a statutory guarantee applies and the law permits limitation, our liability is limited, at our option, to:
- replacement of the goods
- repair of the goods
- payment of the cost of replacing or repairing the goods
- re-supply of the services
- payment of the cost of re-supplying the services
18. Indemnity
You agree to indemnify us against claims, losses, liabilities, damages, costs, and expenses we reasonably incur arising from:
- your misuse of the website
- your breach of these Terms
- your violation of any law or the rights of a third party
- false, misleading, or inaccurate information provided by you
This clause applies only to the extent permitted by law.
19. Termination and Suspension

Termination does not affect any rights, liabilities, or obligations accrued before termination.
20. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them.
If a dispute arises out of these Terms, both parties agree to first attempt to resolve the issue amicably in good faith by contacting the other party before commencing any legal proceedings.
21. Events Beyond Our Control (Force Majeure)
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control. This includes, but is not limited to, strikes, lock-outs, natural disasters, pandemics, severe weather, freight or transport disruptions, or failure of public or private telecommunications networks. In such events, our obligations will be suspended for the duration of the event.
22. Changes to These Terms
