Terms and Conditions
TERMS & CONDITIONS
PAYMENT – Payment will be made by cash on delivery, or by company cheque, or by bank cheque, or by direct transfer, or by any other method as agreed to between the Customer and the Seller. Surcharge applies for credit card payments (1% for MasterCard and VISA, 3% for AMEX). Full payment must be made before delivery unless otherwise stated. A deposit of 20% must be paid before items are ordered. Cheques have to be cleared before items are delivered. Only bank or company cheques are acceptable. Payment for custom made equipment must be made in full before delivery or despatch.
WARRANTY – The warranty shall be the current warranty provided by the manufacturer of the Goods, unless otherwise stated. The Seller shall be under no liability whatsoever, except for the express conditions as detailed and stipulated in the manufacturer’s warranty. There is no warranty on second hand items, unless warranty is purchased separately from the seller.
QUOTES – quotes are valid only for 21 days. All prices exclude GST unless otherwise stated. Quotes are also subject availability of items in stock with Seller or Manufacturers or Suppliers.
DELIVERY
- Delivery dates are estimates only subject to transport conditions, but the Company will use its best endeavours to maintain these estimates.
- The Seller may arrange for the delivery of the Goods into the Customer’s premises at the Customer’s expense. Otherwise delivery extends only to door service.
- Delivery costs are not included in price quoted.
- Standard delivery is fork lift on/off. Separate charges apply for tail lift delivery. Customer must inquire beforehand.
- The Seller shall not be liable for any loss or damage whatever due to failure by the Seller to deliver the Goods (or any of them) promptly or at all.
PICK UP – Items that require to be picked up must be kept ready for delivery and moved to an accessible place. Extra charges may apply for removals and moving.
MISC. - Accessories and parts associated to the main item are not included in the price unless specified.
TRADE-IN – cost of cleaning, labour and other associated costs for trade-in, consignment and buy-off are not included in quotes.
REFUNDS – a 20% re-stocking fee will apply for cancellation of orders. There is no refund on goods after 7 days from the date of purchase, unless the Seller uses discretion under the circumstances. Refunds for custom made equipment are subject to manufacturer’s conditions. Refunds will not be acceptable on custom made equipment, unless items are substantially different from the original nature.
CANCELLATION OF ORDER - No order may be cancelled, modified or deferred without the prior consent of the Seller and if such consent is given, the Seller will be reimbursed for all losses, including loss of profits, and paid a cancellation and restocking fee (being not less than 20% of the invoice value of the Goods). If orders are cancelled without notice to the Seller, any deposit paid will be forfeited by the Customer at the Seller’s discretion. Cancellation of orders on custom made equipment will be subject to manufacturer’s conditions.
DEFECTS / RETURNS - The Customer shall inspect the Goods on delivery and shall within fourteen (14) days of delivery notify the Seller of any alleged defect, shortage in quantity, damage or failure to comply with the description or quote. The Customer shall afford the Seller an opportunity to inspect the Goods within a reasonable time following delivery if the Customer believes the Goods are defective in any way. If the Customer shall fail to comply with these provisions, the Goods shall be conclusively presumed to be in accordance with the terms and conditions and free from any defect or damage, and no returns will be accepted. For defective Goods, which the Seller has agreed in writing that the Customer is entitled to reject, the Seller’s liability is limited to either (at the Seller’s discretion) replacing the Goods or repairing the Goods provided that:
- the Goods are returned at the Customer’s cost within fourteen (14) days of the delivery date;
- the Seller will not be liable for Goods which have not been stored or used in a proper manner;
CUSTOMER’S DISCLAIMER - The Customer hereby disclaims any right to rescind, or cancel the contract or to sue for damages or to claim restitution arising out of any misrepresentation made to him by any servant or agent of the Seller and the Customer acknowledges that he buys the Goods relying solely upon his own skill and judgement and that the Seller shall not be bound by nor responsible for any term, condition, representation or warranty other than the warranty given by the Manufacturer which warranty shall be personal to the Customer and shall not be transferable to any subsequent Customer.
RISK - The Goods are entirely at the risk of the Customer from the moment the Goods leave the Company's premises unless prior arrangements for insurance have been made.
DEFAULT & CONSEQUENCES OF DEFAULT - If the Customer defaults in payment of any invoice when due, the Customer shall indemnify the Seller from and against the entire Seller’s costs and disbursements including on a solicitor and own client basis and in addition all of the Seller’s nominees costs of collection.
DISCLAIMER - Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.
